Eligibility

To use Swift Response’s emergency response services, you must be at least 18 years of age or have the consent of a parent or legal guardian and you must have paid the requisite subscription fees. By using our services, you represent and warrant that you meet these eligibility requirements. If you are accessing our services on behalf of an organization, you must have the authority to bind that organization to these Terms of Service.

Service Description

Swift Response offers emergency response services, including medical assistance, security support, and road rescue response, which can be accessed through our mobile application, website, or designated emergency contact channels. By requesting our services, you consent to our emergency response team responding to your location and providing the necessary assistance based on the information provided.

Service Limitations

While we strive to provide timely and accurate assistance, our services are subject to various limitations, including but not limited to:

  1. Geographic Limitations: Swift Response’s services may not be available in all geographic areas. Service availability may be affected by local laws and regulations.
  2. Communication Limitations: The effectiveness of our services relies on reliable communication networks. We are not responsible for any delays or disruptions in communication that may affect our ability to provide assistance.
  3. Service Type Limitations: Swift Response provides emergency response services only and does not cover non-emergency situations or long-term medical care.
  4. Service Provider Limitations: We may rely on third-party service providers, such as medical facilities or security agencies, to provide assistance. We are not liable for the actions or omissions of these service providers.
  5. Acts Beyond Reasonable Control limitations: We shall not be liable for any delay or failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, pandemics, strikes, or government actions.

Emergency Response Fee

Swift Response’s emergency response services may be subject to fees, which will be communicated to you before requesting assistance. By using our services, you agree to pay the applicable fees as described.

User Responsibilities

When using Swift Response’s services, you agree to:

  1. Provide Accurate Information: You must provide accurate and truthful information when requesting assistance. False or misleading information may hinder our ability to help effectively.

Promotional SMS

Limitation of Liability

To the maximum extent permitted by law, Swift Response International Group Limited and its officers, directors, employees, affiliates, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services, including but not limited to, any damages for loss of profits, goodwill, use, data, or other intangible losses, even if Swift Response has been advised of the possibility of such damages. This limitation of liability applies to all claims, whether based on warranty, contract, tort, or any other legal theory, and whether or not Swift Response has been advised of the possibility of such damages. Swift Response is not responsible for any actions or omissions of third-party service providers or for any indirect damages caused by their actions or inactions.

Indemnification

You agree to indemnify, defend, and hold harmless Swift Response International Group Limited, its officers, directors, employees, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to your use of the services, your violation of these Terms of Service, or your infringement of any intellectual property or other rights of any person or entity. Swift Response reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate fully with Swift Response in asserting any available defenses.

Intellectual Property

All content on the Website, including text, graphics, logos, images, and software, is the property of Swift Response International Group Limited or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Website without our express written permission.

Force Majeure

Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms of Service or the use of the services shall first be attempted to be resolved through good-faith negotiation. If such efforts prove unsuccessful, the dispute shall be resolved by binding arbitration under the rules of Kenya. The decision of the arbitrator shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. By using our services, you agree to submit to the personal jurisdiction of the courts located in Kenya for any actions for which Swift Response retains the right to seek injunctive or other equitable relief.

Severability
